1. Agreeing to these terms
These Terms of Service are an agreement between you and [business legal name] (“Easy Prep with Heather,” “we,” “us”). By creating an account, subscribing, or letting us prepare food in your home, you agree to these terms and to our Cancellation & Refund Policy, Food Safety & Allergen Notice, and Privacy Policy, which are part of this agreement.
You must be at least 18 years old and able to make decisions about the home where we'll be preparing food. If you don't agree, please don't use the service.
2. What we do
We are a personal chef service. At your request, we plan a weekly menu with you and prepare those meals in your home, in your kitchen, using groceries bought for you or by you. Depending on the dish, we leave meals assembled for the freezer or slow cooker, or prepped and refrigerated for you to finish cooking.
We do not run a restaurant, sell packaged food, or cook in a commercial kitchen, and we don't deliver or ship prepared food. Final cooking and the storage of meals after we leave are done by you, following the instructions we provide.
3. Your plan and billing
- Weekly subscription. Plans renew automatically every week and are billed in advance to the payment method on file until you cancel. There's no minimum term.
- Cancelling. You can cancel online any time with Cancel my plan on the Billing page of your account, or by emailing us. Cancelling stops all future charges. The week you've already paid for is still prepped, as described in our Cancellation & Refund Policy.
- Groceries. If we shop for you, we charge the actual cost of groceries after each prep, plus the shopping fee shown on your plan. Receipts are available on request. If you do your own shopping, you pay your store directly.
- Authorization. You authorize us and our payment processor, Stripe, to charge your payment method for your plan, add-ons, shopping fee and grocery costs.
- Failed payments. If a charge fails, we may pause your plan until it's resolved. We won't prep a week that hasn't been paid for.
- Price changes. We'll give you at least 14 days' notice by email before a plan price changes. You can cancel before it takes effect.
- Taxes. Prices don't include any sales tax that may apply. Where required, tax is added at checkout.
5. Prep visits and access
- We schedule prep visits within the window you choose and confirm the time with you. Visits usually take two to three hours.
- You agree to give us safe access at the scheduled time, either by being home or through the access instructions you provide. If you give us a key or door code, you authorize us to enter only to perform the service, and we'll keep it confidential.
- Please keep pets secured, and let us know about anyone else who will be home. We can't supervise children while we work, so an adult needs to be responsible for any kids at home.
- We won't photograph your home, family or belongings. We may photograph the finished food for our own records or marketing only if you say that's OK.
- We may decline to begin, or may end, a visit if conditions are unsafe or unsanitary, or if anyone in the home is abusive or acting inappropriately. In that case the visit is treated as a missed visit under our Cancellation Policy.
- Rescheduling and missed visits are covered in the Cancellation & Refund Policy.
6. Your responsibilities
To give you safe, delicious meals, you agree to:
- Provide a clean kitchen with working appliances, running hot water, and enough fridge and freezer space for your meals.
- Keep your profile accurate, especially allergies, intolerances and dietary restrictions for everyone who will eat the food, and update it before your next menu if anything changes.
- If you do your own shopping, have every item on your list in your home and in good condition before your visit. If something is missing or spoiled, we'll do our best with what's there, and that week's menu may change.
- Store, thaw and cook meals exactly as instructed, and follow our Food Safety & Allergen Notice.
7. Food safety, allergies and health
We follow safe food handling practices while we prepare your meals. Because we work in your kitchen, with your equipment, and the food is stored and cooked by you after we leave, food safety is a shared responsibility. Please read the Food Safety & Allergen Notice, which is part of these terms.
We cannot guarantee that any meal is free of a particular allergen. Gluten-free and dairy-free versions are made with substitute ingredients but are prepared in a kitchen that may contain those allergens. If anyone in your home has a severe or life-threatening allergy, or celiac disease, talk with us before subscribing.
Our menus and descriptions are not medical or nutritional advice. If you have a medical condition or special dietary needs, check with your doctor or a registered dietitian.
8. Your home and property
We treat your home with care and leave the kitchen clean. Normal wear on cookware and appliances from ordinary use is expected. If you believe we damaged something, please tell us within 48 hours of the visit so we can look into it and make it right where we're responsible.
We aren't responsible for damage caused by appliances or equipment that were faulty before we used them, or for items not disclosed to us as fragile or valuable.
9. Our recipes and content
Our recipes, menus, methods, photos and website content belong to us or our licensors. You get cooking instructions for your own household's use. You may not copy, publish or sell our recipes or content, or use them to run a competing service.
Recipes you add to your account stay yours. We use them only to cook for your household unless you tick the box allowing us to add one to our collection. If you do, you give us a free, permanent right to prepare that recipe for other clients, adapt it, and show its name, description and photo on our website. Only share recipes you have the right to share. Cooking a recipe you gave us follows the same food safety steps as our own, but you're responsible for telling us about any ingredient in it that you or your guests react to.
If you leave a review, rating or comment, you give us permission to use it, along with the name you chose to be credited with, on our website and marketing. You can ask us to remove a published review at any time.
We publish reviews whether they're glowing or critical. We only decline ones that contain offensive language or private information, aren't about our service, or that you haven't given us permission to share. Nothing in these terms stops you from posting an honest review anywhere you like.
10. How we contact you
You agree that we can contact you by email, phone or text message about your service, such as menus, scheduling, billing and policy updates. We'll only send marketing messages if you've asked for them, and you can opt out any time. If we text you, message and data rates may apply, and you can reply STOP to opt out of texts.
11. Your account
Keep your login details private. You're responsible for activity on your account. You can pause or cancel at any time from your account. We may suspend or end service if these terms are broken, if payments aren't made, or if we can no longer safely serve your area, and we'll refund any week you've paid for that we don't prep.
12. Warranties and limits of liability
We provide the service with care and skill, but otherwise “as is.” To the fullest extent the law allows, we make no other promises, express or implied, including about taste, fitness for a particular purpose, or results of any diet.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for any illness, injury or loss that results from food being stored, thawed, reheated or cooked other than as instructed, from ingredients you provided, from allergy or dietary information that was missing or inaccurate, or from the condition of your kitchen or equipment.
Our total liability for any claim relating to the service is limited to the amount you paid us in the four weeks before the claim arose. Nothing in these terms limits liability that can't be limited by law, including for our own gross negligence or willful misconduct.
You agree to indemnify and hold us harmless from claims by others (including guests in your home) arising from your breach of these terms, from inaccurate information you gave us, or from food being shared, stored or cooked contrary to our instructions.
13. Disputes and governing law
If something goes wrong, please contact us first at hello@easyprepwithheather.com and give us 30 days to try to resolve it informally. Most things can be fixed with a conversation.
These terms are governed by the laws of the State of [state]. Any dispute that can't be resolved informally will be handled in the state or small claims courts located in [county], [state], and you and we consent to that venue.
14. Changes and the fine print
We may update these terms from time to time. If we make a material change, we'll email you or show a notice in your account at least 14 days before it takes effect. Continuing to use the service after that means you accept the new terms.
We aren't responsible for delays or missed visits caused by events outside our reasonable control, such as severe weather, illness, power outages or emergencies. If that happens, we'll reschedule or refund the affected week as described in our Cancellation & Refund Policy.
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a provision right away, we haven't waived it. These terms, together with the policies linked above, are the entire agreement between us about the service. You may not transfer your account to someone else.
